L-1A / L-1B (Overseas Intracompany Visa)

L-1A (Overseas Intracompany Visa for Managers)

Description
The L-1A visa is a non-immigrant visa which allows foreign nationals coming to work in the U.S. as a manager or executive or functional manager for an employer that is related to a company they worked for prior to entering the US.

Duration of Stay
The L-1A visa is usually issued for three years with multiple entries. An L-1A visa holder can extend his/her stay in two years increments for a total of 7 years.

Accompanying Family
Dependents (spouse and unmarried children under the age of 21) of an L-1A visa holder can obtain an L-2 visa. They must submit a visa application individually.

Requirements
A beneficiary for an L-1A visa must:
  • Have been continuously employed abroad for one year of the last three for a parent, affiliate, or subsidiary of a US employer
  • Have a sponsoring U.S. employer
  • Be coming as a manager or executive or functional manager
  • Intend to depart the US when his/her stay is over

The sponsoring U.S. employer must:
  • Have a "qualifying relationship" with the foreign company. Both the US and the foreign company must have common majority ownership, or, where there is less than majority ownership, common control by the same person or entity.
  • Obtain approval of the petition from the U.S. Citizenship and Immigration Services

Special Considerations
  • L-2 visa holders may attend school in the U.S. An L-2 Spouse can obtain employment authorization to accept employment.


L-1B (Overseas Intracompany Visa for Skilled Workers)

Description
The L-1B visa is a non-immigrant visa which allows foreign nationals coming to work in the U.S. as specialized knowledge and skills for an employer that is related to a company they worked for prior to entering the US.

Duration of Stay
The L-1B visa is usually issued for three years with multiple entries. An L-1B visa holder can extend his/her stay for a total of 5 years.

Accompanying Family
Dependents (spouse and unmarried children under the age of 21) of L-1B visa holders can obtain an L-2 visa. They must submit a visa application individually.

Requirements
A beneficiary for a L-1B visa must:
