E-2 (Investor Visa)

Description
The E-2 visa is a non-immigrant visa which allows a foreign entrepreneur of a treaty nation to enter into the U.S. and carry out investment and trade activities.

Duration of Stay
The E-2 visa is usually issued for two years. After 2 years, the E-2 visa holder in the U.S. must either leave the U.S. and re-enter or obtain an extension while in the U.S. The E-2 visa holder is allowed to extend his/her stay in two year increments as long as he/she maintains E-2 qualifications.

Accompanying Family
Dependents (spouse and unmarried children under the age of 21) of E-2 visa holders can obtain an E-2 Dependent visa. They must apply individually.

Requirements
  • Be the national of the country that has an investor treaty with the U.S.
  • Be serving his/her company in a capacity that is supervisory or executive in nature or involves skills essential to the operation of the business (key employee); or he/she is a 50 per cent owner of the company
  • Be a citizen of a country owning at least 50 per cent of the stock of the company i.e. the firm has the nationality of the treaty country
  • Intend to depart the U.S. at the conclusion of his/her duties

Special Considerations
E-2 dependent visa holders may attend school in the U.S. E-2 spouses may apply for work authorization upon admission to the U.S.
